It is important that you read these Website Terms of Sale (“Terms of Sale”) carefully before ordering any products from our Website (“Product(s)”). By clicking on the “Place Your Order” button in the Order Confirmation section of the Website when placing your order with us (“Order”) you agree to these Terms of Sale. Please understand that if you refuse to accept these Terms of Sale, you will not be able to order any Product(s) from our Website.
We may change these Terms of Sale at any time by updating this page, although changes will not apply to existing Contracts.
You may have other rights granted by law, and these Terms of Sale do not affect these except if the two are inconsistent. If this is the case then these Terms of Sale will override any other rights which you may have, unless this is not permitted by law.
Mary Shoes Ltd offers delivery for the UK, Europe, USA, and Canada. All deliveries are subject to stock availability and authorization of your payment.
We can either deliver your order to an address of your choice or MaryShoes store. Once a transaction has been successfully processed, delivery times are as follows:
FREE delivery to Mary Shoes store. Available in 24hours.
Standard delivery: 3- 5 working days, £4.50.
FREE standard delivery on orders of £100.00 or more.
Next working day delivery if the order is placed before 11.00am: £8.00.
(Please allow at least 24 hours for your transaction to be processed. Working days are considered to be Monday to Friday.)
In the unlikely event that you receive the wrong order, please contact us as soon as possible so we can arrange for the item(s) to be collected and the correct one(s) to be dispatched to you.

For items ordered for collection at store, there is no delivery charge. Delivery to the store will be within 24hours. You will receive an email that your order has arrived, and it will be held at the store for 5 working days for your collection. After this time, the shoes will cease to be reserved for you and will return to general store stock.
All payments must be made at the time of dispatch of the Product(s) to you. Payment for all Product(s) must be by credit card or debit card. We accept payment by the following card types: Visa, Maestro, Mastercard. If we are unable to accept your Order for any reason then we will, at our option, either not debit your credit card or refund any money paid by you in respect of that Order. We will not dispatch the Product(s) until we receive payment in full.
Prices are liable to change at any time, but changes will not affect Orders which we have already confirmed as described above.
For payment by card, all credit and debit cardholders and bank/building society account holders respectively may be subject to authorization and authentication. If the issuer of your payment card or our service provider refuses to or does not for any reason authorize or validate the payment, we will not be liable in these circumstances for any delay or non-delivery in respect of the Product(s) which you have ordered as a result.
Order confirmation; acceptance of contract:
We send you a confirmation email within 24 hours of your order being placed to confirm receipt of your order. Orders placed by you are an offer to purchase and will be accepted by us, subject to stock availability. Once you have received your confirmation email, we can't change the details of the order (product, quantities or delivery address). There is a delay between the time when the order is placed and the time when the order is accepted and the order confirmation email is not a guarantee of stock availability. On occasion, the stock position relating to particular items may change. If an item is not in stock at the time of processing your order, we will let you know as soon after the order has been placed as possible and you will be refunded in full if you were charged for the out of stock item(s).
The contract for the sale of the goods will be formed when we send an e-mail confirmation to you that we've dispatched the product to you at the address you provide us with. Acceptance will be complete at the time that we send this email to you.
Orders can be canceled at no charge up until shipment. When your order ships, you’ll receive an email entitled "Shipment Notification for order#XXXXXXX with www.maryshoes.co.uk ." Orders that have already shipped cannot be canceled and will be treated as returns. Items must be in their original condition, unworn and returned within 7 working days of receiving them. We make every effort to ensure that your order is carefully despatched to you, and we hope that you're happy with your purchase. However, Under the United Kingdom's Distance Selling Regulations you have the right to cancel your order and receive a refund from us. To do so you must inform us in writing within 7 working days from the day after receipt of your order to Mary Shoes Ltd, 16 Wentworth Street, London, E1 7TF or by email at firstname.lastname@example.org . Returning any item within 7 working days will also be taken as notice of cancellation of your order (or part of your order). Please quote your order number on all correspondence. If you contact us by telephone you will need to follow this up with confirmation to us in writing either by e-mail or post.
If you choose to cancel then you must return the Product(s) to us at your cost and risk and we advise you to ensure the Product(s) are adequately insured during the return journey. You must ensure that you take reasonable care of the Product(s) including the original box supplied with the Product(s) if any. Please try on any footwear you have received from us indoors with socks. As set out in the “Damaged or Defective Product(s)” section, you have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
If you have not returned the Product(s) within 7 working days of cancellation or when requested by us to do so, whichever occurs first, we can collect the Product(s) from you at your cost.
You can return any item for an exchange or refund within 7 working days of purchase if you are not completely satisfied with it. Returned items must be returned to us unworn and in the original condition you received it from us and accompanied by the invoice. You should follow the procedure below:

1) Direct to Mary Shoes store
For an immediate refund or exchange, you can return the items to Mary Shoes store, (with the exception of the products specified as non-refundable), within 7 working days with a valid proof of purchase.
What to do: take your items to be returned to Mary Shoes store. You MUST have your despatch note and/or the invoice. If the item is in its original condition, we will process the refund for you.
2) Return by post
You can return your items by post.
What to do: complete and detach the returns note and enclose it, together with your returned items, inside the original packaging. Goods cannot be returned without this information.
For International orders - we cannot offer free exchanges on international orders. If you want to exchange an item, please return the item to us within 7 working days and re-order it again.
If you return a Product to us for any reason, we will examine the item and notify you of your refund via email within a reasonable period. Refunds will be processed shortly after, but the funds could take up to 21 days to return to your payment card, depending on the payment provider. When we return funds to you, we will be using the same means of payment as you used for the initial transaction.
Damaged or Defective Product(s)
Subject to any specific warranties we offer in relation to particular products, or those which are implied by law, we do not offer any warranty or guarantee on our products. In connection with the circumstances in which the Product(s) are supplied by us, the warranties implied by law are that the Products comply with the descriptions provided by us, are fit for purpose and are of satisfactory quality.
You should inspect the Product(s) when you receive them for defects or damage. Please try on any footwear you have received from us indoors with socks. You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. If you find a defect or damage and you are not happy with your purchase you must tell us as soon as possible by writing to us at email@example.com or Mary Shoes Ltd, 16 Wentworth Street, London, E1 6JE and return the Product(s) to our store.
If the Product(s) are found to be damaged prior to delivery to you, or defective (through no fault of your own wearing or use), we will repair or replace the Product(s) or refund the price paid by you, including any delivery charges you paid either when ordering the Product (if you are being given a refund) or returning the item to us, provided that you have not worn or used and damaged the Product(s). If you would prefer repair or replacement of the Product(s) please contact us and we will replace the item at no extra charge to you where this is reasonably practicable.
If the Product(s) are found to have been damaged after delivery to you, we will contact you to let you know and discuss this with you. It is your responsibility to arrange collection of any unauthorised returns from our premises, for example, Products which have been returned because they were defective but which are subsequently found not to be defective; accordingly we reserve the right to return these Products to you at your cost. We will be unable to refund any delivery charges you paid either when ordering the Product or returning the item to us.
These Terms of Sale do not exclude our liability (if any) to you for:
personal injury or death resulting from our negligence;
Any matter which it would be illegal for us to exclude or to attempt to exclude our liability
Subject to paragraph (v) above, we are only liable to you for losses which you suffer as a result of a breach of these Terms of Sale by us. Our liability for losses you suffer as a result of us breaching these Terms of Sale is strictly limited to no more than 125% of the purchase price of the Product you purchased and this cap includes any losses which are a foreseeable consequence of us breaching these Terms of Sale. Losses are foreseeable where they could be contemplated by you and us at the time your Order is accepted by us.
Subject to paragraph (v) above, we are not responsible for indirect losses which happen as a side-effect of the main loss or damage and which are not foreseeable by you and us, including but not limited to:
loss of income or revenue;
loss of business;
loss of profits or contracts; or
loss of anticipated savings
provided that this shall not prevent claims for loss of or damage to your tangible property in accordance with your statutory rights or paragraph (vi) or any other claims for direct financial loss that are not excluded by any of the above categories of loss of this paragraph (vii).
Subject to paragraph (v) above, we are not responsible for any delay in, or failure of, performance of our obligations under these Terms of Sale arising from any cause beyond our reasonable control including any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion, failure in information technology or telecommunications services, failure of a third party (including failure to supply data) and industrial action.
To the extent permitted by law, Mary Shoes Ltd gives no warranties in relation to the website, in particular with limitation, any warranties regarding the accuracy of descriptions and illustrations of items on the website.
We have taken all reasonable precautions to ensure that the information provided on this website is accurate; in particular that prices shown are correct at the time of publishing and that all items have been fairly described. Whilst all reasonable effort has been taken to display items colours accurately, we cannot guarantee that your monitor's display will accurately reflect this.
All sizes and measurements are approximate; however, we do make every effort to ensure they are as accurate as possible. Unless otherwise stated, sizes indicated are UK sizes.
We reserve the right to change at any time any of the details of the items on the site, including prices, colours, and sizes.

Prices are as set out on the website but exclusive of delivery charges. We reserve the right to alter prices at any time.
If we discover an error in the price or description of an item you have ordered, we may cancel your order at any time up to the point we send the item(s) to you. We will contact you where we become aware of an error and ask you whether you wish to continue with your order at the correct price or cancel it. If we do cancel your order you will receive a full refund of any charges paid in advance.
We continually update our online store. From time to time our store may run special local promotions (which may not be available on our website) or we may offer special promotions online that are not available in the store. For these reasons you may sometimes find that product on our Web site are priced differently to those in our store.
